SMS/Text Message Terms & Conditions (Surfing Santas of Cocoa Beach)

These SMS/Text Message Terms & Conditions (“SMS Terms”) govern participation in the Surfing Santas of Cocoa Beach text messaging program (the “Program”). By opting in to receive text messages from Surfing Santas of Cocoa Beach (“Surfing Santas,” “we,” “us,” or “our”), you agree to these SMS Terms.
1) Program (Brand) Name

2) Program Description
The Program provides subscribers with event announcements, schedule updates, parking/shuttle information, livestream links, reminders, and time-sensitive event-day alerts related to Surfing Santas of Cocoa Beach.
3) Program Phone Numbers
Program messages may be sent from either (or both) of the following phone numbers:

Note: Program numbers may change in the future. If they do, we will update this page.
4) How to Opt In
You may opt in to receive text messages by providing your mobile number through one of our sign-up forms, keyword-based sign-up, written consent, or other opt-in methods we make available. By opting in, you confirm that:
- You are the authorized user of the mobile number provided, or you have permission to enroll the number; and
- You agree to receive text messages from Surfing Santas of Cocoa Beach at that number.
Consent is not a condition of purchase.
5) Message Frequency
Message frequency varies. We may send more messages during major announcements, the days leading up to the event, and on event day. At other times, messages may be occasional.
6) Costs and Fees
Message and data rates may apply based on your mobile plan and carrier. Surfing Santas does not charge you for participating in the Program, but your carrier may charge for message and/or data usage.
7) Supported Carriers
The Program may not be available on all carriers or on all devices. Participating mobile carriers may change without notice. Surfing Santas does not guarantee message delivery or availability across all carriers and devices.

You may also reply HELP to a Program message (where supported) to receive basic information about the Program and opt-out instructions.
9) Opt-Out Instructions
You can opt out of the Program at any time by replying STOP to any Program message.
After you send STOP, you may receive one final confirmation text confirming that you have been unsubscribed. You will no longer receive Program messages unless you opt in again.
10) Re-Enrollment (Opt Back In)
If you previously opted out and want to rejoin the Program, you may do so by signing up again through our available opt-in methods.
11) Message Delivery and Carrier Disclaimer
Text messaging is not always reliable. Message delivery is subject to transmission availability and may be affected by your mobile carrier, device, coverage, network conditions, filtering, and other factors outside our control.
Carriers are not liable for delayed or undelivered messages.
12) Eligible Use and Prohibited Activities
You agree not to use the Program in a way that:
- Violates any law, regulation, or these SMS Terms;
- Harasses, threatens, or harms others;
- Attempts to interfere with the Program’s operation, security, or integrity;
- Submits false, misleading, or unauthorized phone numbers or opt-ins.
We may suspend or terminate participation in the Program for suspected abuse or unlawful activity.
13) Privacy and Mobile Information
We respect your privacy.
- We use your mobile number and related opt-in/opt-out status to send you the messages you requested and to manage your participation in the Program.
- We may store records related to your consent, message delivery, and opt-out requests to operate the Program and to help with compliance and dispute resolution.
Mobile Information: We do not share, sell, rent, or trade your mobile phone number, SMS opt-in information, or mobile messaging data for third-party marketing or advertising.

14) Changes to the Program or Terms
We may modify or discontinue the Program at any time, including changing the types of messages sent, the frequency of messages, or the phone number(s) used.
We may update these SMS Terms from time to time. When we do, we will update the Effective Date at the top of this page. Changes become effective when posted.
15) Disclaimer of Warranties
The Program is provided on an “as-is” and “as-available” basis. To the maximum extent permitted by law, we disclaim warranties of any kind, express or implied, regarding the Program.
16) Limitation of Liability
To the maximum extent permitted by law, Surfing Santas is not liable for any damages arising out of or related to the Program, including (without limitation) delayed or undelivered messages, service interruptions, errors, or unauthorized access.
17) Governing Law
These SMS Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where applicable law requires otherwise.
